This document aims to define the terms and conditions under which, on the one hand, Healing Singing Bowls, provides users with access to the website and the services available on the site, and on the other hand, the manner in which users access the site and use its services.
Access to the site is subject to compliance with these conditions.

Terms of Sale
These terms of sale are established on one hand by Healing Singing Bowls, with its registered office located at chetrapati chowk Kathmandu 44600 Nepal, hereinafter referred to as "Healing Singing Bowls", and managing the website "https://healingsingingbowls.com", and on the other hand, by any natural or legal person wishing to make a purchase of a product via the website "https://healingsingingbowls.com".
Article 1. Purpose
These terms of sale aim to define the contractual relationships between Healing Singing Bowls and the buyer, as well as the conditions applicable to any purchase made through the website https://healingsingingbowls.com. The acquisition of a product through this site implies an acceptance without reservation or restriction by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing an order. The buyer also declares to have the full legal capacity allowing them to commit to these general terms of sale without the possibility of recourse, except for the application of the right of withdrawal when the customer places and validates their order on the website electronically. The sale is deemed concluded when the payment method is selected. At this stage, the order is validated. This validation by the customer constitutes a handwritten signature between the parties.
Healing Singing Bowls reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.
Article 2. Products
The products offered are those listed on the website "https://healingsingingbowls.com" of Healing Singing Bowls, within the limits of available stock. Healing Singing Bowls reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description detailing its main technical characteristics. The photographs, texts, information, and features illustrating the products are as accurate as possible but are not contractual and therefore do not engage the responsibility of Healing Singing Bowls.
Article 3. Prices
The prices listed on the product pages of the online catalog are in euros (€) and inclusive of all taxes (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the product prices. Healing Singing Bowls reserves the right to modify its prices at any time. The prices applicable are those in effect at the time of order registration and are firm and final regardless of any subsequent price changes, whether upward or downward. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased based on the total amount of the order.
Article 4. Ordering and Payment Terms
Prior to placing an order, the buyer must create an account on the website "https://healingsingingbowls.com". During each visit, if the buyer wishes to place an order or access their account (order status, profile, etc.), they must identify themselves using their login information. Healing Singing Bowls offers the buyer the option to order and pay for products in several steps, with the following payment option :
Bank Transfer Payment
The buyer selects the products they wish to order on the "cart," makes any necessary modifications (quantities, references, etc.), verifies the shipping address, or provides a new one. Then, the shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses the preferred payment method: "Bank Transfer." Finally, the last step prompts them to review all the information, acknowledge and accept the present terms and conditions of sale by checking the corresponding box, and then prompts them to confirm their order by clicking on the "Order with obligation to pay" button. This final click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation confirming the registration of their order. To finalize their payment and initiate the processing of their order, the buyer must contact their bank to make the corresponding transfer to Healing Singing Bowls' bank account, the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed, and the buyer will be notified by email.
Any bank transfer not received within 15 days following the order will result in its cancellation.
Secure Payment by Credit Card (via Prestashop Checkout by PayPal)

Then, the shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses the preferred payment method: "Payment by credit card." The next step prompts them to review all the information, acknowledge and accept the present terms and conditions of sale by checking the corresponding box, and then prompts them to confirm their order by clicking on the "Order with obligation to pay" button.
Finally, the buyer is redirected to the secure Prestashop Checkout by PayPal interface to securely enter their credit card details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use thereof, the buyer may demand the cancellation of the payment by card, and the amounts paid will then be credited or refunded. The cardholder's liability is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without the physical use of their card. To obtain reimbursement for fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must contest the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract with the bank so provides. The amounts debited are refunded by the bank within a maximum of one month after receipt of the cardholder's written dispute. No fees for the return of sums may be charged to the cardholder.
Confirmation of an order implies acceptance of these terms of sale, recognition of having full knowledge of them, and waiver of reliance on one's own purchasing conditions. All data provided and the recorded confirmation shall constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, Healing Singing Bowl will send them an email confirmation of the registration of their order.

Article 5. Right of Withdrawal
The buyer has a period of fourteen working days from the receipt of the goods to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for the initial shipping costs and return fees.
Article 6. Delivery
Deliveries are made to the address specified on the order form, which can be anywhere internationally, as Healing Singing Bowl ships its products globally from Nepal. Orders are processed using reliable international shipping services. Delivery times provided are estimates and may vary depending on the destination and customs clearance processes.
Healing Singing Bowl will provide the buyer with tracking information for their shipment when possible, allowing them to monitor the delivery status. In case the buyer is unavailable to receive the package at the time of delivery, they will receive a notification from the shipping carrier, providing instructions for collecting the package or arranging for re-delivery.
Any issues related to shipping, including damage or loss during transit, should be reported to Healing Singing Bowl promptly for assistance.
The buyer is responsible for verifying the condition of the package and its contents upon delivery. In the event of any damage or discrepancies, the buyer should document the issue and contact Healing Singing Bowl to initiate the resolution process.
Returns or exchanges of merchandise are subject to the policies outlined in Article 5 (Retraction). The buyer must ensure that returned items are in their original packaging and condition.
Any additional costs incurred due to the buyer's absence or incorrect address information will be borne by the buyer. It is essential for the buyer to provide accurate and complete shipping information to ensure smooth delivery.

Article 7. Warranty
All products provided by Healing Singing Bowl are covered by the legal warranty. In the event of non-conformity of a product sold, it may be returned to Healing Singing Bowl, which will either exchange it or provide a refund. All claims, exchange requests, or refund requests must be made by email to contact@healingsingingbowls.com.
Article 8. Liability
Healing Singing Bowl shall not be held liable for any non-performance of the contract in the event of stock shortage from the supplier or unavailability of the product, in case of force majeure, in case of delay in deliveries for any reason whatsoever, in case of modification of the product's characteristics by the suppliers that are no longer in line with the information provided on the website, or in case of damage resulting from the use of the internet network such as data loss, intrusion, virus, service interruption, or other involuntary issues.
Article 9. Intellectual Property

No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the website, whether they are in the form of photos, logos, visuals, or text.

Healing Singing Bowl is committed to preserving the confidentiality of the information provided by the buyer, which may be transmitted for the use of certain services. In this regard, the user has the right to access, modify, and delete information concerning them. They may request this at any time by email to contact@healingsingingbowls.com.
Article 11. Dispute Resolution
These distance selling terms and conditions are subject to Nepali law. For any disputes or litigation, the competent court shall be located in Nepal. However, for international transactions involving products from Nepal, any disputes or litigation shall be resolved through arbitration in accordance with the rules of the International Chamber of Commerce (ICC) in Paris, France. The arbitration shall take place in Paris, and the language of arbitration shall be English.
